This bill requires that peace officers cooperate with investigations by the Peace Officers Standards and Training Council. It also requires that employers provide employment related information (i.e., written information in an employer's records or personnel files relating to the behavior or performance of the applicant, candidate or peace officer) to another law enforcement agency when they are conducting an investigation to hire, certify or renew the certification of a peace officer. The information that the employer is required to disclose includes performance evaluations, disciplinary actions and eligibility for rehire. The law enforcement agency seeking the employment related information must include a copy of a signed and notarized statement from the applicant, candidate or peace officer releasing and holding the employer harmless for disclosing complete and accurate information to the law enforcement agency.

This bill exempts energy savings performance contracts from the requirements of the local government public works construction law.  Counties will still be required to follow the procedures established in the energy savings performance contract statute, but certain provisions that were not intended to apply to county government have been removed (i.e., requiring the use of the State's prequalified list of providers). Counties will be required to issue a request for proposals to at least two qualified energy service providers, as well as advertise the contract opportunity by posting it at the board of commissioners' office and on the county's website, if one exists.

This bill extends (from June 30, 2012 to June 30, 2015) the life of the Georgia Geospatial Advisory Council (GGAC). ACCG was a strong advocate of establishing the GGAC, which has audited Georgia's geospatial capabilities at the local, regional and state level. It also recommends how to best utilize these capabilities to meet FEMA notification requirements, achieve governmental data interoperability, and enhance the delivery of services to Georgia citizens.

SB 401 amends the Georgia Cogeneration and Distributed Generation Act of 2001 (the Act) to provide a greater range of financing tools, including power purchase agreements, for distributed generation projects. (Distributed generation is electric power provided by customers on their premises primarily to meet their on-site needs.)  It also expands Georgia’s distributed generation statute to add biomass, municipal solid waste, landfill gas, and hydropower as eligible resources and to remove existing caps on the size of individual projects. 

 

This applies to when commercial companies own and operate customer-sited solar systems and lease solar equipment or sell solar electricity generated on-site to local governments at or below current utility costs.
